We expect this visit to be more of the same from the Biden administration following Harris' visit to Central America in which she said "Don't come" to prospective asylum seekers —a message that incapsulates the weakness of their plans to address root causes of migration and their pandering to Republican bluster. NWIRP BREAKING NEWS: Over 130 Organizations, Including Legal Services Providers, Urge DOJ and DHS to Reject Expedited “Dedicated Dockets” for Asylum Seekers

Over 130 organizations sent a letter this week to the White House and the Departments of Justice and Homeland Security opposing a proposed process for expedited “dedicated dockets” for asylum-seeking families that was announced by the agencies on May 28. The letter was signed by 62 organizations providing immigration legal services to individuals facing removal proceedings in the ten cities that were listed in the May 28 announcement.

In the letter, the organizations urge the agencies to abandon the proposed “dedicated docket process” before its implementation begins, or at a minimum delay implementation until the agencies can take steps to ensure that the families undergoing the process have guaranteed access to legal representation and to a restored and enhanced asylum system. The organizations pointed out that legal providers in the ten cities listed in the May 28 announcement are already under-funded and must reject a large number of requests for pro bono legal representation from non-citizens facing removal proceedings. In fact, there were over 140,000 deportation cases pending in the immigration courts in those ten cities in which the individual was not represented by an attorney as of the end of May 2021. People facing deportation hearings do not currently have the right to appointed counsel if they cannot afford an attorney, even though the federal government is represented by an experienced attorney in every case.

An end to Title 42 in its entirety is imperative. This news is partial good news, tempered by its limitations lifting the rule for families only. That means expulsions under this rule will likely continue, impacting disproportionately African, Middle Eastern, LGBTQ asylum seekers and many others. We will continue to press the administration for its full rescission.

Waiting for Justice in Immigration Court

"A draft plan recently obtained by The New York Times indicates that the Biden Administration is expected to rescind some of the most damaging Trump Administration policies.

But what the administration has in mind for immigration courts is unclear. Its initiative, unveiled in late May to fast track newly arrived, undocumented families placed in immigration proceedings is a big step in the wrong direction.

Under the plan, families are assigned to immigration courts in ten cities, where they are not detained but are expected to find legal representation and have their asylum cases decided within 300 days. “Rocket dockets,” intended to speedily work through the cases were tried under Obama and Trump, but were fraught with problems.

'They’re doing the same failed policy that they know results in due process violations and lack of representation,' says Denver immigration lawyer Christina Brown, who was previously involved with rocket dockets. 'I don’t understand how they could reach this conclusion unless the goal is to keep deporting Central Americans without a fair chance to file asylum claims.'

Rescinding Trump-era restrictions would only be a start toward radical reform.

Harris' visit to Guatemala (and today she's in Mexico) is part of her agenda to address root causes, according to the Biden administration. An incredibly disappointing SCOTUS decision was issued today that will impact many TPS holders and cause confusion and fear in the immigrant community. Ultimately what is needed is a permanent solution for TPS holders, and a path to citizenship for immigrants with temporary status as well as all who are undocumented. While broader and inclusive immigration reform and relief is the ultimate goal, in the short term, TPS must be extended for those countries who status is about to expire and that remain in crisis.

"'Unethical reporting' is no exaggeration. Probably the media’s greatest failure has been in playing down a major humanitarian crisis on the other side of the border: the US government’s expulsion of thousands of asylum seekers back into Mexico under Title 42 of the public health code. Aside from some good opinion pieces (Washington Post, 3/22/21; Boston Globe, 4/26/21), there have been little more than a few passing references to this Trump era policy, which the Biden administration is continuing (with some modifications). But we find a serious lack of balance even if we only consider the reporting about the situation on the border’s US side.

Establishment coverage has featured hyperbole about recent migration trends and an inexcusable lack of historical context. Worse yet, this style of reporting could have serious consequences in the real world: It may sabotage prospects for a long overdue reform of the US immigration system."
