Appeal Update

‼️UPDATE‼️

We have some good news to share! The stay on our case in the court of appeals has been lifted and oral arguments are currently scheduled for April 14, 2021 at 1:30pm.

In 2017, Broomfield residents passed issue 301 which amended our City Charter to ensure our local government protects our residents from the adverse impacts from oil and gas development. Our Appeal argues that we have standing to enforce our City Charter and we want our case heard in the Broomfield courts.

We expect a decision some time after oral arguments. Hopefully our next communication will share more good news.

Multiple plumes including measurable levels of benzene have been linked back to the location of the Livingston site. The Air Quality Monitoring Team is working with the COGCC and CDPHE to determine what could be causing this “phenomenon.”

Benzene is a known human carcinogen, and the Livingston Site is located in the middle of three communities and is not far from schools. All reports show that levels are still considered “safe.” But the question remains, has low level exposures such as this been adequately studied to rule out any harm?

Multiple VOC Spikes Recorded in the Vicinity of the Livingston Site. – Broomfield Concerned – A Coalition of Neighborhoods

On July 11th, a short VOC spike at Soaring Eagle park was detected around 7:45 PM by Boulder AIR. These findings were also confirmed and supported by similar data captured by AJAX sensors. This plume was characterized as being “very rich in methane and VOC’s” that “points toward a petroleum hydrocarbon source.” The report concluded this event most likely came from a “raw natural gas release” and most likely “originated from relatively close emission source” to the Soaring Eagle Park monitoring location.

Take Action: Protect Air Quality During A Respiratory Pandemic

We have learned of a confirmed case of COVID-19 in one of the neighborhoods closest to this project. The spread of this virus is on a crash course collision with the start of flowback operations at the Livingston site. This site is 1300 ft from a 55+ community, where people living there are all considered high risk.

We have learned from a City update that Extraction is not willing to voluntarily stop operations during this crisis.

So it is up to our City to act, to protect the health, safety, and welfare of our residents and vulnerable population. Residents are asking the City to pause this project until the emergency order is lifted.

Broomfield Asks COGCC for Help with Noise Complaints Coming from Livingston Pad – Broomfield Concerned – A Coalition of Neighborhoods

Broomfield asks the COGCC to intervene with the on-going noise issues in Broomfield. Broomfield Residents have been plagued with on-going overnight noise, resulting in loss of sleep and other health issues. Residents Rights has always maintained that people have an inherent right to live safely in their homes. This has gone on long enough. It is time for our government to protect people.

We received disappointing news on Feb 18th in the Erie Thriving case: Judge Mulvahill awarded summary judgement to the Defendants. The remaining claims in our case were dismissed 2 weeks before the scheduled trial.

This lawsuit was filed to hold our elected officials accountable for approving an Operator Agreement that we consider to be one of the most problematic locations for oil and gas development in the state.

Unfortunately, the courts ruled in favor of the Town of Erie. This reiterates the importance of Erie's upcoming elections. We can hold this Board accountable for the decisions they made and in the manner in which they made them and we can elect people who will fight harder for the protection of the health and safety of it's residents.

As an organization, we will continue to fight for the basic human rights of our community to live in a healthy and safe environment.

"RECENT AJAX AIR QUALITY REPORT REVEALS CONCERNING RESULTS, INCLUDING AN UNEXPECTED TOXIC CHEMICAL MEASURING ABOVE HEALTH GUIDELINES."

RECENT AJAX AIR QUALITY REPORT REVEALS CONCERNING RESULTS, INCLUDING AN UNEXPECTED TOXIC CHEMICAL MEASURING ABOVE HEALTH GUIDELINES.

The Broomfield community was made aware of high levels of the chemical Tetrachloroethylene at the Air Quality monitoring study session on Tuesday, February 18th. AJAX Analytics, the company hired by Broomfield to monitor the potential toxins released into the air by residential oil and gas operations, detected high levels of this unexpected chemical at the Livingston Site on February 1. The safe threshold limit for this chemical based on the Agency for Toxic Substances and Disease Registry (ATSDR) is 6 parts per billion (ppb) for both acute and chronic exposure. Levels found in the grab sample were 40 ppb.

In addition to finding the above chemical, the AJAX report states that Broomfield has set new maximum-level records for many of the chemicals being analyzed. Chemical levels that set new record levels include but are not limited to benzene, ethylbenzene, and toluene. It is important to note that these chemicals found are still reporting within the “safe” range based on existing EPA and CDPHE exposure guidelines, however this is no consolation to the people who are being exposed.

The last piece of important information brought forward in this study session is that emissions were recorded during the flowback process despite the closed loop system that was put into place. Many residents and some council members expected that the closed loop system would make the flowback phase safer, as all emissions should theoretically be captured. AJAX indicated that the emissions found were lower than traditional flowback sites but remain in-line with what was recorded during the drilling and fracking phases.

With temps below zero this morning, you can see the VOCs spewing off of the Livingston pad in Broomfield with the naked eye. It’s typically not visible without the technology of a FLIR camera.
This is our reality living next to an industrial oil and gas extraction site.

Residents Rights has learned its Broomfield members continue to be impacted by overnight noise, disrupting sleep. Lack of sleep has many negative impacts on people.

The overnight noise is happening despite the recently passed emergency noise ordinance. Without doing anything to address these noise issues, Broomfield is allowing adverse impacts to happen to its Residents as a result of oil and gas development.

Residents Rights stands in solidarity with its impacted members and commits to continue to fight for the basic right of property enjoyment.

Will you stand with us? If yes, please write Broomfield City Council today, and demand they put a stop to the noise nuisances that are adversely impacting Broomfield Residents.

Anthem Highlands residents are reporting high levels of noise from nearby oil and gas operations this morning. Consistent C-scale noise readings over 65 dbC. The loud humming noise can be heard in this video. This isn’t the peaceful community these residents envisioned moving into.
