A Research Paper Presented to the Syrian Legal Forum by: Judge Amir Al Bakri "Judicial Independence in Syria between the 1950 constitution and the 2012 one"
The stability of a society is not achieved without equitable justice and the justice has no equity unless it was completely independent from other authorities.
The judiciary in light of the 1950 constitution:
The judiciary was in a golden age from 1950 until 1958 where it went through a regression of sorts which was coupled with military coups the last of which was the coup led by Hafez Al-Asaad in 1970.
Judiciary in light if the 1973 constitution in the period of Hafez Al-Asaad and his heir Bashar Al-Asaad:
In this period, the regime tried to contain the indignation of the masses, so it intended to publish a constitution which gave the president absolute authority despite cancelling article 8 which stated that the Baath party is the party leading the country and the society and cancelling the Supreme State Security Court and to lift the state of emergency, while on the other hand published a law of anti-terrorism and formed a terrorism tribunal.
